In this Agreement we are Escape Boutique 185-187 Park View, Whitley Bay, Tyne and Wear, NE26 3RE/Mitchells Menswear, 177 Park View, Whitley Bay, Tyne & Wear, NE26 3RE and you are the person detailed on the Order Summary.
Upon ordering we are not making a legal offer to provide the goods ordered. We are inviting you to make a legal offer to us for you to purchase the goods. It is entirely at our discretion to reject or accept your offer of purchase. All orders are subject to availability and confirmation of the order price.
This Agreement is only confirmed when we have accepted your offer to purchase the goods and have sent you an invoice or dispatch receipt that includes the date of the Agreement being accepted which will be the date shown on said invoice or receipt.
Basis of Sale
The terms of the Agreement with you shall govern our contract to the exclusion of any other terms and conditions.
No variation to this Agreement shall be binding unless agreed in writing by us.
Whilst every effort is made to ensure the information and pricing on this site is correct, we reserve the right to change or amend any typographical, clerical or other error or omission in any sales literature, price list, acceptance of offer or other document or information issued by us.
You are responsible for ensuring the accuracy of your Order and the details provided on your Order Form.
The quantity and description of your chosen products shall be those set out in the Order Form unless we subsequently agree otherwise in writing.
The pictures may not be a true representation of the item and colours may vary in certain cases.
Price of Goods and Payment
The Price of Goods shall be the price quoted by us on our Website next to the illustration/description of your chosen product, unless agreed otherwise by us in writing. Where applicable all prices quoted are inclusive of VAT.
Delivery costs will be charged in line with those set out in our Postage Costs. Any additional postage costs will be clearly displayed where applicable and will be included in the total cost on the Order Summary.

Payment can be made using only the methods above and payment of your full order will be taken immediately. The total amount you pay is the same regardless of the payment method. All payments are Secure and handled by Sagepay.
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the pricing of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and have already paid for the goods you will receive a full refund. We are not obliged to sell a product at an incorrectly listed price.
Promotional discount codes may be issued in relation to all products on this Website or may be restricted to specific products.
Promotional Discount Vouchers can only be used once and are not to be combined with any other offer. Vouchers are redeemable on full price items only.
Promotional Discount Codes cannot be used after an order has been placed.
In accordance with the UK distance selling regulations, you have the right to cancel your order within 7 working days following delivery of your order and, if necessary, return the goods to us for a full refund. Please go to Returns Policy for our full returns terms and conditions.

Third Party Links
We warrant that you will be entitled to the benefit of any warranties or guarantees given by the suppliers to us of your chosen product. This does not affect your statutory rights.
You warrant that the information entered onto the Order Form is true.
Where we sell to you under a consumer transaction (as defined by the Consumer Transactions (Restrictions on Statements) Order 1976) your statutory rights are not affected by this Agreement.
Risk of Property
Risk of damage to or loss of your chosen products shall pass to you on delivery.
You will be responsible for the safe keeping and insuring of all products whilst in your possession.
We shall have no liability to you or be deemed to breach this contract for any failure or delay in supply or delivery or of any damage or defect to products supplied or delivered that is caused by any event or circumstance beyond our control (including, without limitation, civil disturbance, act of God, strikes, lockouts or other industrial disputes, power failure or breakdown of machinery). In any of these circumstances we reserve the right to withdraw the agreement.
