Agreement

In this Agreement we are Escape Boutique, 185-187 Park View, Whitley Bay, Tyne & Wear, NE26 3RE and you are the person detailed on the Order Summary.

These Terms and Conditions along with our Invoice and Privacy Policy constitute the Agreement between you and us to the provision of goods you have offered to purchase.  These conditions supersede all other proposals both aural and written.

Upon ordering we are not making a legal offer to provide the good ordered.  We are inviting you to make a legal offer to us for you to purchase the goods.  It is entirely at our discretion to reject or accept your offer of purchase.  All orders are subject to availability and confirmation of the order price.

This Agreement is only confirmed when we have accepted your offer to purchase the goods and have sent you an invoice or dispatch receipt that includes the date of the Agreement being accepted which will be the date shown on said invoice or receipt.

Basis of Sale

The terms of the Agreement with you shall govern our contract to the exclusion of any other terms and conditions.

No variation to this Agreement shall be binding unless agreed in writing by us.

Whilst every effort is made to ensure the information and pricing on this site is correct, we reserve the right to change or amend any typographical, clerical or other error or omission in any sales literature, price list, acceptance of offer or other document or information issued by us.

You are responsible for ensuring the accuracy of your Order and the details provided on your Order Form.

The quantity and description of your chosen products shall be those set out in the Order Form unless we subsequently agree otherwise in writing.

The pictures may not be a true representation of the item and colours may vary in certain cases.

Price of Goods and Payment

The Price of Goods shall be the price quoted by us on our Website next to the illustration/description of your chosen product, unless agreed otherwise by us in writing.  Where applicable all prices quoted are inclusive of VAT. 

Delivery costs will be charged in line with those set out in our Postage Costs.  Any additional postage costs will be clearly displayed where applicable and will be included in the total cost on the Order Summary.

Payment can be made using only the methods above and payment of your full order will be taken immediately.  The total amount you pay is the same regardless of the payment method.  All payments are Secure and handled by Opayo.

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur.  If we discover an error in the pricing of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming you order at the correct price or cancelling it.  If we are unable to contact you we will treat the order as cancelled.  If you cancel and have already paid for the goods you will receive a full refund.  We are not obliged to sell a product at an incorrectly listed price. 

Discount Codes

Promotional Discount Codes may be offered from time to time, the terms of use relating to any discount codes offered will be specified at the time of issue and will be relevant to that specific code only.

Promotional discount codes may be issued in relation to all products on this Website or may be restricted to specific products.

Promotional Discount Vouchers can only be used once and are not to be combined with any other offer.  Vouchers are redeemable on full price items only.

Promotional Discount Codes cannot be used after an order has been placed.

Returns

In accordance with the UK distance selling regulations, you have the right to cancel your order within 14 working days following delivery of your order and, if necessary, return the goods to us for a full refund.  Please go to Returns Policy for our full returns terms and conditions.

Privacy

Information is collected from you when you register with us, order goods from us, sign up to receive updates or when you participate in competitions & surveys.  This may include name, mailing address, telephone number and email address.  This information is collected from you in order to process your order correctly and provide the best possible service.

We will treat all of your personal information as confidential and will not be shared with any third party, all information is kept on a secure server and will fully comply with UK Data Protection and consumer legislation.

External links may be provided for your convenience and to increase value to our Users but they are beyond the control of the Website Owner and no representation is made as to their content.  Use or reliance on any external  links and the content therein is at your own risk.  When visiting external links you must refer to the terms and conditions and privacy policy of that website.

Warranties

We warrant that you will be entitled to the benefit of any warranties or guarantees given by the suppliers to us of your chosen product.  This does not affect your statutory rights.

You warrant that the information entered onto the Order Form is true.

Where we sell to you under a consumer transaction (as defined by the Consumer Transactions (Restrictions on Statements) Order 1976) your statutory rights are not affected by this Agreement.

Risk of Property

Risk of damage to or loss of your chosen products shall pass to you on delivery.

You will be responsible for the safe keeping and insuring of all products whilst in your possession.

Force Majeure

We shall have no liability to you or be deemed to breach this contract for any failure or delay in supply or delivery or of any damage or defect to products supplied or delivered that is caused by any event or circumstance beyond our control (including, without limitation, civil disturbance, act of God, strikes, lockouts or other industrial disputes, power failure or breakdown of machinery).  In any of these circumstances we reserve the right to withdraw the agreement.
